How many elements of the original must the copy contain to be still recognisable as a "logical image" of the original?
Between the identical reproduction (only possible theoretically) and the derived work that is still just recognisable as a copy, the creator has a certain amount of leeway.
It is not a question of logic but instead a matter of discretion of the courts to what degree this creative leeway must be used by the author to create an "individual" intellectual creation and thus a copyright-protected work of art.
